Hermès is denouncing the project of digital artist Mason Rothschild, claiming that it infringes the House’s intellectual property rights. Mason Rothschild has designed and monetised “MetaBirkins”, bags inspired by Hermès famous Birkin, into NFT digital bags.
With a multicoloured, fur-inspired design, artist Mason Rothschild has taken inspiration from one of Hermès iconic bags, creating a hundred different variations on it. Mason Rothschild had already made a name for himself when he created the “Baby Birkin” in NFT in collaboration with the painter Eric Ramirez.

These “MetaBirkins” NFTs are sold on the OpenSea marketplace. Moreover, they are selling at record prices, exceeding $20,000. In total, Mason Rothschild has reportedly achieved over $790,000 in sales for these digital bags.

According to Hermès, the difficulty lies in the fact that the public thinks that the “MetaBirkins” collection in NFT is produced by the House, when it is not.
“Hermès has neither authorised nor consented to the marketing or creation of our Birkin bag by Mason Rothschild in the metaverse,” the Financial Times reports, quoting Hermès as calling the 100 NFTs “fake Hermès products”.
This initiative does not please the House at all. Indeed, a spokesperson for the brand of Hermès said of the matter, “These NFTs infringe Hermès’ intellectual property and brand rights and are an example of counterfeit Hermès products in the Metaverse.”
While Hermès accuses the artist Mason Rothschild of infringing the House’s intellectual property rights, Mason Rothschild himself has been upset by the copies of his MetaBirkins.
As a result of this case, Hermès is potentially planning to take legal action against artist Mason Rothschild’s “MetaBirkins” collection.
