Last December, Hermès accused a digital artist of damaging its brand image and was potentially planning to take legal action against the “MetaBirkins” collection. Now, that is no longer a possibility as Hermes is suing Mason Rothschild for speculating on the Birkins bags.
To recall the facts, Hermès denounced the project of the artist Mason Rothschild, claiming an infringement of the House’s intellectual property rights. Indeed, Mason Rothschild was inspired by Hermès’ emblematic bags, in order to imagine and commercialize “MetaBirkins” in digital NFT bags.

At stake was the fact that the public thinks that the ‘MetaBirkins’ collection in NFT is produced by the House, when it is not. Indeed, “Hermès neither authorised nor consented to the marketing or creation of our Birkin bag by Mason Rothschild in the metaverse” reported the Financial Times, quoting Hermès as calling the 100 NFTs “fake Hermès products”.
In the civil complaint filed in Manhattan federal court, Hermès accuses Mason Rothschild of being a “digital speculator seeking to get rich quick by appropriating the MetaBirkin trademark” for the sale of NFTs. Moreover, “the MetaBirkin brand simply appropriates the famous Hermès brand name, Birkin, by adding the prefix meta”.

Hermès added that Mason Rothschild had “openly acknowledged that he chose to sell his NFTs on behalf of Metabirkins because a Birkin handbag is a valuable commodity in the real world”.
Mason Rothschild reacted strongly to the legal action against him: “Hermes’ claims are unfounded, I do not create or sell fake Birkin bags. I have made artworks that depict imaginary Birkin bags covered in fur.” He added, “The fact that I sell art using NFTs does not change the fact that it is art. I hope Hermes understands that I won’t be intimidated.”
