Tiffany loses its case against Cotsco

Tiffany has lost its lawsuit against Costco. The luxury brand accused Costco of counterfeiting and trademark infringement.

 

After nearly eight years, Tiffany & Co‘s lawsuit accusing Costco Wholesale Corp of counterfeiting and trademark infringement for selling generic diamond engagement rings bearing the name “Tiffany” has reached a verdict. The court of appeals ruled in favor of Costco.

 

The court said that Costco acted in good faith and that Costco customers were smart enough to realize that Tiffany & Co. did not manufacture or approve the “Tiffany” rings.

 

The settlement came after a federal appeals court in Manhattan overturned a $21 million judgment last August viagra generika schweiz rezeptfrei.

 

A trial judge had previously found Costco liable for selling the disputed rings, despite the claim that “Tiffany” had become a generic term and described the rings’ setting.

 

David Bernstein, an attorney for the Costco Group, said the two companies “have amicably resolved their dispute”. This information was confirmed by Tiffany & Co, which issued a similar statement.
